RE: The tariff classification of quartz digital wrist watch from China

Dear Ms. Bartel:

In your letter dated June 8, 2000, you requested a tariff classification ruling on a quartz digital wrist watch from China. A sample of the sport watch was submitted with the ruling request.

The submitted American Girl Watch, identified as style number 6009, is a wrist watch containing a battery-operated electronic watch movement with a liquid crystal display (LCD) in a round transparent plastic case with a stainless steel back. The display features hour, minute, second, date, month and weekday. The words “SUPER TIME” are printed above the display and the word “AGSTAR” is printed above the words “SUPER TIME”. The words “American Girl” are printed below the display.

The American Girl Watch will be imported and sold with two interchangeable straps. One watch strap is made of PVC and the word “AGSTAR” is printed on the strap. The other watch strap is made of polyester. The polyester strap consists of a lower portion and an upper portion that are sewn together at one end, and secured by strips of Velcro sewn onto the lower and upper portions. The word “AGSTAR” appears on the polyester strap and the words “SUPER TIME” appear directly below the word “AGSTAR”.

You have indicated that the movement, plastic case, PVC strap and polyester strap are made in China. The battery is made in Japan and the watch is assembled in China.

The applicable subheading for the American Girl Watch will be 9102.12.80, Harmonized Tariff Schedule of the United States (HTS), which provides for wrist watches, pocket watches and other watches, including stop watches, other than those of heading 9101; wrist watches, electrically operated, whether or not incorporating a stop watch facility; with opto-electronic display only; other. The rate of duty will be free.

The applicable subheading for the polyester watch strap will be 9102.12.20, Harmonized Tariff Schedule of the United States (HTS), which provides for straps, bands or bracelets entered with watches of subheading 9102.12.80 and classifiable therewith pursuant to additional U.S. note 2 to this chapter; all the foregoing whether or not attached to such watches at the time of entry; of textile material. The rate of duty will be free.

The applicable subheading for the PVC watch strap will be 9102.12.40, Harmonized Tariff Schedule of the United States (HTS), which provides for straps, bands or bracelets entered with watches of subheading 9102.12.80 and classifiable therewith pursuant to additional U.S. note 2 to this chapter; all the foregoing whether or not attached to such watches at the time of entry; other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
