RE: The tariff classification of housed bearings from India

Dear Ms. Mizgala:

In your letter dated May 17, 2000 you requested a tariff classification ruling on behalf of your client Torrington Company.

The items in question are described as a flanged housing, part number YCJ35, and a pillow block, part number YAS3/4, both of which incorporate ball bearings. Samples were submitted.

The flanged housing is a bearing housing with a square flange with bolt holes for its mounting on a support surface nominally perpendicular to the bearing axis. The housing incorporates a ball bearing. The pillow block is an assembly comprising a ball bearing and a bearing housing. The housing has a base plate with bolt holes for its mounting on a support surface nominally parallel with the bearing axis. Examination of the samples reveals that the bearings are marked to indicate India as the country of origin.

The applicable subheading for the flanged housing with ball bearing will be 8483.20.4040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for housed bearings, flange units, incorporating ball bearings. The rate of duty will be 4.5 percent ad valorem.

The applicable subheading for the pillow block will be 8483.20.8040, HTSUS, which provides for other housed bearings incorporating ball bearings. The rate of duty will be 4.5 percent ad valorem.

Because the ball bearings contained in the subject housed bearings originate from India, it is the opinion of this office that the flanged housed bearing and the pillow block are not subject to antidumping duties under current orders of the Department of Commerce relating to antifriction bearings. Should you desire a binding ruling on the applicability of dumping orders to your merchandise, please write directly to the Department of Commerce, Office of Compliance, Washington, D.C.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR 177).
