RE: The tariff classification of three embroidered trimmings, from China.

Dear Mr. Chisolm:

In your letter dated May 3, 2000, you requested a classification ruling.

Three representative samples were submitted which were identified as styles SVB 2296, SVB 2303 and SVB 2457, respectively.

All three materials consists of narrow woven (jacquard) fabrics composed of 100% polyester man-made fibers that have been embroidered with glass beads. The ground fabrics range from approximately 3/8"to 3/5" in width. These embroidered trimmings are designed for use on apparel, hat and home furnishing products. While it was not specifically mentioned in your letter, it is presumed that these materials will be imported as piece goods.

The applicable subheading for the three materials will be 5810.92.9080, Harmonized Tariff Schedule of the United States (HTS), which provides for embroidery in the piece, in strips or in motifs; other embroidery; of man-made fibers. The duty rate will be 7.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Alan Tytelman at 212-637-7092.

Sincerely,
