RE: The tariff classification of a non-electrical candle lamp from Hong Kong.

Dear Ms. Aldinger:

In your letter dated May 3, 2000, you requested a tariff classification ruling.

The sample submitted is a non-electrical candle lamp, style number 994154, that measures approximately 6 ¾ inches in overall height. It consists of a square-shaped silver-plated stand that measures about 3 1/8 inches long by 3 1/8 inches wide by 1 inch in height. This stand is designed to hold a scented wax-filled glass container that measures nearly 3 1/8 inches in height by 2 ½ inches in width by 2 ½ inches in depth. Further, there is a silver-plated shade, with a reindeer-like motif encompassing its exterior, that is designed to be inserted onto the wax-filled container. It is stated that these lamps will also be imported with diverse colored and scented wax-filled glass containers as well as metal shades with different motifs.

The applicable subheading for this non-electrical candle lamp will be 9405.50.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other non-electrical lamps and lighting fittings, other. The rate of duty will be 6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
