RE: The tariff classification of a handbag and agenda from China.

Dear Mr. Epstein:

In your letter dated April 28th, 2000, on behalf of Avon Products, Inc., you requested a tariff classification ruling.

The samples submitted with your request are identified as "Patchwork Drawstring Bucket Bag with Companion Agenda", PP #207289. Although you have indicated that the handbag will be imported and sold with the agenda, your request does not indicate whether PP #207289 will be presented to Customs put up in a manner suitable for sale directly to users without repacking.

The handbag measures approximately 10 3/4" x 9 1/2" x 5 1/2" and is manufactured of a fabric-backed sheeting of polyvinyl chloride (PVC). The interior of the bag is lined, contains a back-wall zippered pocket and consists of a single compartment with no additional features. The top opening is secured by means of a draw string closure. Two shoulder straps are permanently attached to the bag.

The agenda consists of a cover manufactured of a fabric-backed sheeting of PVC that holds a paper agenda and contains multiple card slots and a clear vinyl slot for a photo on the front interior. The cover is secured by a self-tab with a snap closure. The front exterior also has a clear vinyl slot for a photo.

The applicable subheading for the handbag portion of #PP207289 will be 4202.22.1500, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strapwith outer surface of sheeting of plastic. The rate of duty will be 17.6% ad valorem.

The applicable subheading for the agenda portion of #PP207289 will be 4820.10.2010, Harmonized Tariff Schedule of the United States (HTS), which provides for diaries and address books, bound, of paper or paperboard. The rate of duty will be 1.6% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
