RE: The tariff classification of a 7-piece tool kit with 10 pieces of fasteners from China.

Dear Mr. Myers:

In your letter dated March 22, 2000, you requested a tariff classification ruling. Your submitted sample will be returned to you as requested.

You have described the submitted sample as follows:

7-piece tool kit with 10 pieces of fasteners including:

8oz. tubular claw hammer
3M/10ft measuring tape – containing a steel tape Plastic cutter – utilizing a steel blade to cut 6” long nose pliers (will be with this set, but not with this sample) 2 screwdrivers – with 4” slotted and 4” Phillips blades Clear plastic tool box (not included as it is not yet developed) 10 pc. fasteners – which include five steel self-tapping screws approximately 3 mm in diameter and 1” in length and five steel picture hanging hooks

Each of the items is separately classified and is not considered a set for classification purposes. This tool kit which may be considered utilized in the same general area, does not consist of products put up together to meet a particular need or to carry out a specific activity as explained in the General Explanatory Notes to the Generalized Rules of Interpretation (GRI), Rule 3(b)(X).

The applicable subheading for the claw hammer will be 8205.20.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for hammers and sledge hammers, and parts thereof: with heads not over 1.5 kg each. The duty rate will be 6.2% ad valorem.

The applicable subheading for the measuring tape will be 9017.80.0000, HTS, which provides for other instruments for measuring length, for use in the hand. The duty rate will be 5.3% ad valorem.

The applicable subheading for the plastic cutter will be 8211.93.0060, HTS, which provides for knives with cutting blades, serrated or not (including pruning knives), other than knives of heading 8208, and blades and other base metal parts thereof: other: knives having other than fixed blades: other (including parts). The duty rate will be 3¢ each + 5.4% ad valorem.

The applicable subheading for the 6” long nose pliers will be 8203.20.6030, HTS, which provides for pliers (including cutting pliers), pincers, and parts thereof: other: other (except parts): pliers. The duty rate will be 12¢/doz. + 5.5% ad valorem.

The applicable subheading for the Phillips and slotted screwdrivers will be 8205.40.0000, HTS, which provides for screwdrivers, and parts thereof. The duty rate will be 6.2% ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on the clear plastic toolbox. Your request for a classification ruling should include a sample or a blueprint of the item. Will the toolbox have fitted pockets or not? We understand that the item is in the development stage, but the additional information is required to enable us to classify the item when you are prepared to furnish it.

The applicable subheading for the self-tapping screws will be 7318.14.1060, HTS, which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers, (including spring washers) and similar articles of iron or steel: threaded articles: self-tapping screws: having shanks or threads with a diameter of less than 6 mm: other. The duty rate will be 6.2% ad valorem.

The applicable subheading for the steel picture hanging hooks will be 7326.90.8585, HTS, which provides for other articles of iron or steel, other. The duty rate will be 2.9% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
