RE: The tariff classification of a keyring and toys from Hong Kong

Dear Ms. Aldinger:

In your letter dated March 23, 2000, you requested a tariff classification ruling.

The samples you submitted are three articles designed for children 6 years of age and older. Item number 993608 is called the Dragonball Z Magnetic Keychain. It consists of a steel split ring attached by a short chain to a 3-inch clear plastic tube containing a Dragonball Z figure. Magnets within the article cause the figure to appear to float and bounce when shaken. The second item, number 994099, is the Dragonball Z Clip On Headlight. It is composed of the plastic upper body of the Dragonball Z character with a D-shaped snap hook attached. Two button cell batteries inside light up the character’s hair when his chest is pressed. The last item, number 993609, is the Super Mario Mini Nintendo Game, a handheld video game with a snap hook attached. This item is also available in Donkey Kong and Mario’s Cement Factory versions.

The applicable subheading for the Dragonball Z Magnetic Keychain will be 7326.20.0050, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of iron or steel, articles of iron or steel wire, other. The rate of duty will be 3.9 percent ad valorem.

The applicable subheading for the Dragonball Z Clip On Headlight (item number 994099) will be 9503.90.0045, Harmonized Tariff Schedule of the United States (HTS), which provides for other toys, reduced-size (“scale”) models and similar recreational models, working or not, puzzles of all kinds, parts and accessories thereof, other, other toys and models. The rate of duty will be free.

The applicable subheading for the three Mini Nintendo Games (item number 993609) will be 9504.90.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for game machines, other than coin- or token-operated, parts and accessories thereof. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
