RE: The tariff classification of a travel pouch and wallet from China.

Dear Ms. Anderson:

In your letter dated January 24th, 2000, on behalf of US JHI Corp., you requested a classification ruling.

The samples submitted with your request consist of item #SG5455, a bi-fold wallet, and item #SG5456, a travel pouch. Both articles have an exterior surface of man-made textile materials and have a string of cording attached to the top that enables the user to wear each item around one's neck. The interior of item #SG5455 consists of a currency slot that is secured by a flap with hook and loop closures, an open pocket for credit and I.D. cards and a zippered pocket for currency. The wallet is secured by a hook and loop closure and has an open pocket of clear plastic on the front exterior. Item #SG5456 is square in shape and has a single zippered compartment for various personal items. A self-pen holder is sewn to the side exterior of the bag and a pocket of clear plastic is incorporated on the front of the bag.

The applicable subheading for #SG5456 will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bagswith outer surface of textile materials, other, other, of man-made fibers, other. The duty rate will be 18.6% ad valorem.

Items classifiable under HTS subheading 4202.92.3031 fall within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The applicable subheading for #SG5455 will be 4202.32.9550, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of a kind normally carried in the pocket or handbagof man-made fibers. The duty rate will be 18.6% ad valorem.

Items classifiable under HTS subheading 4202.32.9550 fall within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
