RE: The tariff classification of wearing apparel from Malaysia, China, Northern Mariana Islands, and Italy

Dear Mr. Katz:

In your letter received February 17, 2000, you requested a classification ruling on behalf of Brooks Brothers. Your submission contained too many items for the subject of one letter. This letter will cover five of the ten items submitted for classification. Another letter, which will follow shortly, will deal with the remaining items.

Style 801300 is a men’s 100 percent cotton woven dress shirt. The country of origin is stated to be Malaysia.

Style 851400 is a men’s woven, 100 percent cotton boxer short. It features an open fly, fully elasticized waist and no pockets. The country of origin is stated to be China.

Style 861304 is a men’s 100 percent cotton woven pajama set, consisting of a top and bottom. The top features an open collar, v-shaped neckline, 4 over size buttons on a full open front, a breast pocket, piping around the neck and front opening and long sleeves with cuffs accentuated by piping. The bottoms feature a fully covered elasticized waistband with a drawstring, a one snap closure on the fly, and no pockets. The country of origin is stated to be China.

Style 20280703 is a women’s woven trouser of 90 percent wool and 10 percent nylon fiber. It features cuffed pant legs, a pleated front, two side seam pockets, a buttoned back pocket and a right over left zippered front opening, fastened at the waist with two buttons. The country of origin is stated to be Northern Mariana Islands, an insular possession of the United States.

Style 2002 is a pair of women’s string-knit gloves, made of 20 percent cashmere, 35 percent wool, 30 percent viscose and 15 percent nylon. The gloves feature a ribbed cuff. The country of origin is stated to be Italy.

The applicable subheading for the shirt will be 6205.20.2025, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s or boys’ shirts, of cotton, other, dress, other, other, men’s. The duty rate will be 20.2 percent ad valorem.

The applicable subheading for the boxer shorts will be 6207.11.0000, HTS, which provides for men’s or boys’ underpants and briefs, of cotton. The duty rate will be 6.3 percent ad valorem.

The applicable subheading for the pajamas will be 6207.21.0010, HTS, which provides for men’s or boys’ nightshirts and pajamas, of cotton, with two or more colors in the warp and/or filling, men’s. The duty rate will be 9.1 percent ad valorem.

The applicable subheading for the women’s trousers will be 6204.61.9010, HTS, which provides for women’s or girls’ trousers, of wool or fine animal hair, other, trousers and breeches, women’s. If considered to be a product of the Northern Mariana Islands, pursuant to General Note 3(a)(iv), HTS, this item will be free of duty, otherwise, the duty rate will be 15 percent ad valorem.

The applicable subheading for the gloves will be 6116.91.0000, HTS, which provides for gloves, other, of wool or fine animal hair. The duty rate will be 32 cents/kg plus 7.2 percent ad valorem .

The men’s shirt falls within textile category designation 340. Based upon international textile trade agreements products of Malaysia are subject to quota and the requirement of a visa.

The boxer shorts fall within textile category designation 352. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The pajamas fall within textile category designation 351. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
