RE: The tariff classification of a toiletry bag, handbag, and school satchel from China.

Dear Ms. Tidaback:

In your letter dated February 9th, 2000 you requested a classification ruling.

Three samples were submitted with your request.

Style #F020A09 is a handbag designed to contain money, keys, and small accessories on a daily basis. It measures approximately 14 1/2" x 12 3/4" and has an exterior surface of textile material of 70% acrylic and 30% wool. The interior of the bag is lined and features a central compartment with a zippered back wall pocket. A front flap secures the top opening of the bag and an adjustable shoulder strap is permanently attached to the bag.

Style F020A09 is subject to the Wool Products Labeling Act of 1939.

Style #F020A13 is a school satchel that measures approximately 13 1/4" x 11" x 4 1/2" and has an exterior surface of 100% cotton textile material. The interior of the satchel is lined and has a zippered back wall pocket. A front flap with two snap closures secures the bag and conceals an open pocket on the front of the bag. There is an additional open pocket on the rear exterior of the bag. A zippered coin purse is sold with the satchel and is classifiable under HTS subheading 4202.32.4000 when imported separately. The satchel and coin purse are considered a set under General Rule of Interpretation 3 (b).

Style 71554 is a toiletry bag that measures approximately 7" x 4" x a bottom panel of 2 1/2" and has an exterior surface of 100% crocheted polyester propylene textile material. The interior of the bag is lined and secured by a full width zippered closure.

The applicable subheading for #F020A09 will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strapother, other, other, of man-made fibers. The duty rate will be 18.6% ad valorem.

The applicable subheading for #F020A13 will be 4202.12.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases, vanity cases, attache cases briefcases, school satchels and similar containersof cotton. The duty rate will be 6.7% ad valorem.

The applicable subheading for #71554 will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bagsother, other, of man-made fibers, other. The duty rate will be 18.6% ad valorem.

Items classifiable under HTS subheadings 4202.22.8050 and 4202.92.3031 fall within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

Items classifiable under HTS subheadings 4202.12.4000 and 4202.32.4000 fall within textile category designation 369. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
