RE: The tariff classification of a kitchen blowtorch, thermometer, and timer from China

Dear Ms. Van Den Broeke:

In your letter, dated February 10, 2000, for Bonjour, you requested a tariff classification ruling for three samples.

Your model # CT-88 is the Professional Hotery Chef’s Torch, which you also describe as a Kitchen Blowtorch. It has a Piezo Spark Ignition and uses butane gas. This hand operated tool has a safety lock and a removable safety stand. It is used for caramelising sugar, skinning tomatoes and peppers, and crisping joints of meat.

Your model 6070 is a digital meat thermometer. It can display either in Centigrade or Fahrenheit. It can display the minimum or maximum temperature measured. It has a five inch long metal probe with a sharp point, which is kept in a removable plastic “scabbard” when not in use.

Your model 3082 is a digital meat thermometer with a clock/timer. It can display either in Centigrade or Fahrenheit. It can display the minimum or maximum temperature measured. It has a six inch long metal probe with a sharp point.

The applicable subheading for the blowtorch will be 8205.60.000, Harmonized Tariff Schedule of the United States (HTS), which provides for blow torches and similar self-contained torches and parts thereof. The general rate of duty will be 2.9 percent ad valorem.

The applicable subheading for the meat thermometer will be 9025.19.8040, Harmonized Tariff Schedule of the United States (HTS), which provides for thermometers (not including pyrometers), which are not combined with other instruments, are not liquid-filled, and are not clinical. The general rate of duty will be 1.8 percent ad valorem.

The applicable subheading for the timer-thermometer will be 9106.90.55, Harmonized Tariff Schedule of the United States (HTS), which provides for . The general rate of duty will be percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

The samples are being returned to you in a separate mailing.
