RE: The tariff classification of valves from Mexico and Taiwan

Dear Ms. Severson:

In your letter dated January 12, 2000 you requested a tariff classification ruling on behalf of Honeywell Incorporated.

The items in question are identified as the V845 and V5435 series of valves. Technical literature was submitted.

A typical valve in the V845 series, such as the V845A1067, is a thermostatically controlled automatic gas valve with integral gas cock. These gas control valves combine a manual gas cock, automatic valve operator and gas pressure regulator.

A typical valve in the V5435 series, such as the V5435B1011, is a gas/air module designed to amplify and modulate outlet gas pressure. The valve is self-operating and designed to regulate gas pressure as a function of gas and air flow.

The applicable subheading for the V845 series valves will be 8481.80.9050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other taps, cocks, valves and similar appliances. The rate of duty will be 2 percent ad valorem.

The applicable subheading for the V5435 series valves will be 8481.80.9015, HTSUS, which provides for regulator valves, self-operating, for controlling variables such as pressure. The rate of duty will be 2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR 177).
