RE: The tariff classification of women’s woven wearing apparel from Thailand and Sri Lanka

Dear Ms. Greener:

In your letter dated January 6, 2000, you requested a classification ruling. The samples submitted with your request will be returned to you under separate cover.

Style 017-0960 is a woman’s dress constructed from 100 percent cotton corduroy woven fabric. The dress is sleeveless and features a scooped neckline with a partial opening, an empire waist, one zippered pocket below the waist, a back vent and a back zipper closure. This garment will also be imported in petite and tall sizes under style numbers 017-0961 and 017-0962.

Style 017-1014 is a woman’s jumper constructed from 100 percent cotton corduroy woven fabric. The jumper features oversized armholes, a scooped neckline, a full front opening secured by ten buttons. This garment will also be imported in petite and tall sizes under style numbers 017-1015 and 017-1016.

Style 084-0790 is a woman’s dress constructed from 59 percent acetate and 41 percent polyester woven fabric. The sleeveless dress features a round neckline, side seam pockets, a back vent and a back zippered closure. This garment will also be imported in petite and tall sizes under style numbers 084-0791 and 084-0792.

Style 017-0942 is a woman’s dress constructed from 100 percent cotton woven fabric. The sleeveless dress features a collar, a partial front opening secured by six snap closures, a side zipper closure, side vents and a zippered pocket below the waist. This garment will be imported in petite and tall sizes under style numbers 017-0943 and 017-0944. This garment will also be sold through a catalog in sizes regular, petite and tall. The style numbers will be 011-0942, 011-0943 and 011-0944.

Style 084-0799 is a woman’s dress constructed from 93 percent rayon and 7 percent wool woven fabric. The sleeveless dress features a square neckline, one-inch wide shoulder straps, attached side ties and a back vent.

The applicable subheading for style 017-0960 will be 6204.42.3010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): dresses: of cotton: other: corduroy: women’s. The duty rate will be 10.1 percent ad valorem.

The applicable subheading for style 017-1014 will be 6211.42.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of cotton: jumpers. The duty rate will be 8.4 percent ad valorem.

The applicable subheading for styles 084-0790 and 084-0799 will be 6204.44.4010, Harmonized tariff Schedule of the United States (HTS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): dresses: of artificial fibers: other: other: women’s. The duty rate will be 16.4 percent ad valorem.

The applicable subheading for style 017-0942 will be 6204.42.3050, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ suits, ensembles, suit -type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): dresses: of cotton: other: other: other: women’s. The duty rate will be 10.1 percent ad valorem.

Styles 017-0960 and 017-0942 fall within textile category designation 336, styles 084-0790 and 084-0799 fall within textile category designation 636; style 017-1014 falls within textile category designation 359. Based upon international textile trade agreements products of Thailand and Sri Lanka are subject to quota restraints and a visa requirement.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
