RE: The tariff classification of two ponchos from China

Dear Mr. Quinter:

In your letter dated December 13, 1999, on behalf of Hellman Worldwide Logistics, Inc., 10450 Doral Blvd., Miami, FL. 33178, you requested a tariff classification ruling. Your samples are being returned under separate cover.

The submitted samples, styles 4676 and NEX-AW-G02, are two sleeveless ponchos. Style number 4676 is a woman’s circular shaped poncho that is constructed from 100% Shetland wool, knit fabric. The garment features a hood with a tie closure, a fringed bottom, and is pulled over the wearer’s head.

Style NEX-AW-G02 is a girls’ poncho that is constructed from 70% lambswool, 20% angora, 10% nylon, knit fabric. The garment is pulled over the wearer’s head and features a crew neck and a fringed bottom.

The applicable subheading for the two ponchos will be 6102.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s and girls’ overcoatscapesand similar articles, knitted or crocheted, other than those of heading 6104: of wool or fine animal. The duty rate will be 60.9 cents/kg+17.8% ad valorem.

The ponchos fall within textile category designation 435. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
