RE: The tariff classification of (Item #C62C-0222) 5 pc. Laundry Ball Set and (Item#C62C-0223) 7 pc. Laundry Ball Set from China

Dear Ms. Liu:

In your letter dated December 22, 1999, you requested a tariff classification ruling.

The samples submitted are as follows:

Item #C62C-0222 consists of two reusable plastic balls, two retail bags of pellet (laundry balls) and one plastic container (45g) of stain remover.

Item #C62C-0223 consists of three reusable plastic balls, two retail bags of pellet (laundry balls) and one plastic container (45g) of stain remover.

In your literature, you indicated that the above products are used to wash clothes in a washing machine. The pellets are poured into the plastic reusable balls and placed into the washing machine. The stain remover may be applied to help remove stains before placing the garment into the washing machine. These products are packaged together and put up for retail sale.

The applicable subheading for the 5 pc. and 7 pc. Laundry Ball Set will be 3402.20.1000, Harmonized Tariff Schedule of the United States, which provides for Organic surface-active agents (other than soap); surface-active preparations, washing preparations (including auxiliary washing preparations) and cleaning preparations, whether or not containing soap, other than those of heading 3401: Preparations put up for retail sale: Containing any aromatic or modified aromatic surface-active agent. The rate of duty will be 4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
