RE: The tariff classification of a woman’s woven upper body garment from Hong Kong

Dear Ms. Cheung:

In your letter dated December 7, 1999, you requested a classification ruling. The sample submitted with your request will be returned to you under separate cover.

Style 59-35536 is a woman’s upper body garment constructed from 74 percent cotton, 22 percent nylon and 4 percent spandex woven fabric. The garment features a V-neckline, ¼ inch wide shoulder straps, a side zipper closure, decorative trim around the top edge and an allover embroidered design. The top back edge is cut straight across from side seam to side seam. This garment will also be imported in petite sizes under style number 69-38682.

The applicable subheading for style 59-35536 will be 6211.42.0081, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of cotton: other. The duty rate will be 8.3 percent ad valorem.

Style 59-35536 falls within textile category designation 359. Based upon international textile trade agreements products of Hong Kong are subject to quota restraints and a visa requirement.

If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
