RE: The tariff classification of Wire Strippers and Pipe Cutters from China.

Dear Ms Smith:

In your letter dated November 30, 1999 you requested a tariff classification ruling.

Two samples submitted are Wire Strippers (Stock nbr 73319 is also a crimper and 73320 is a wire stripper). Both tools have grip handles. Two samples submitted are Pipe Cutters (Stock nbrs 73325 and 73321).

The samples will be returned as per your request.

The applicable subheading for the Wire Strippers will be 8203.20,6060, Harmonized Tariff Schedule of the United States (HTS), which provides for Pliers (including cutting pliers), pincers, tweezers and similar tools, and parts thereof: Other. The rate of duty will be 12 cents/dozen + 5.5% ad valorem.

Pipe cutter 73325 is made of 52% zinc alloy, 22% metal rod, 26% SK-2 alloy. Included in the material is 0.43% chromium. The applicable subheading for this pipe cutter will be 8203.40.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for Pipe cutters, bolt cutters, perforating punches and similar tools, and parts thereof: With cutting part containing by weight over 0.2% of chromium, molybdenum, or tungsten or over 0.1% of vanadium. The rate of duty will be 6% ad valorem. The applicable subheading for pipe cutter (Stock 73321) will be 8203.40.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for Pipe cutters, bolt cutters, perforating punches and similar tools, and parts thereof: Other. The rate of duty will be 3.3% ad valorem.

Please note the rates of duty will be the same in 2000.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
