RE: The tariff classification of plastic shower heads from China.

Dear Ms. Pike:

In your letter dated November 29, 1999, on behalf of your client Teledyne Water Pik, you requested a classification ruling.

You have submitted four samples of water massage, pulsating shower heads that are made of plastic. They are identified as model numbers JM-320, JM-321, JM-350 and JM-351. The shower heads have three settings: regular spray, pulsating spray and combination spray. These shower heads may be hand-held or wall mounted.

Model number JM-350 is a shower head that is made of plastic with a chrome finish. The shower head is packaged with a grey reinforced plastic hose and mounting brackets.

Model number JM-351 is a white colored shower head that is made of plastic. It is packaged with a white reinforced plastic hose and mounting brackets.

Model number JM-320 is a plastic shower head with a chrome finish. Model number JM-321 is a white shower head made of plastic. These shower heads are packaged separately without a hose or mounting brackets.

The applicable subheading for all of the above mentioned models of plastic shower heads will be 3924.90.5500, Harmonized Tariff Schedule of the United States (HTS), which provides forother household articles and toilet articles, of plastics: other, other. The rate of duty will be 3.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
