RE: The tariff classification of fans from China

Dear Ms. Crowe:

In your letter you requested a tariff classification ruling on behalf of your client Honeywell Consumer Products.

The items in question are a stand fan, model HS-2010, and four window fans, models DW-624, DW-628, DW-620, and WDW-6280. The fans are of an axial design, equipped with a flexible supply cord for connection to a 120-volt supply of alternating current, and are for general domestic use. Except for model DW-624, the fans have electrical ratings ranging from of 1.21 to 1.30 amperes at 120 volts, which exceed 125 watts. The model DW-624 window fan has an electrical rating of 0.61 amperes at 120 volts, which is less than 125 watts.

The applicable subheading for the model HS-2010, DW-628, DW-620, and WDW-6280 fans will be 8414.59.6090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other axial fans. The rate of duty will be 2.3 percent ad valorem.

The applicable subheading for the model DW-624 window fan will be 8414.51.0090, HTSUS, which provides for other window fans, with a self-contained electric motor of an output not exceeding 125 watts. The rate of duty will be 4.7 percent ad valorem

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
