RE: The tariff classification of Quickset Timer made in China

Dear Ms. Maloney:

In your letter dated November 18, 1999, on behalf of Bonjour, Inc., you requested a tariff classification ruling on the Quickset Timer made in China. A sample of the Quickset Timer was submitted with the ruling request.

The sample submitted with your letter, style number 8100, is identified as the Quickset Timer. The Quickset Timer is a digital electronic timer and clock. The Quickset Timer contains a battery-operated electronic movement with a liquid crystal display (LCD) housed in a round plastic case. The article displays the present time and counts up/down to 99 minutes in seconds. The time and timer are set by rotary dial. The Quickset Timer clips, stands and hangs. It is a magnet for metal surface attachment. The Quickset Timer requires one AAA battery to operate. The battery is included. The article measures approximately 3 inches in length by 3 inches in width. According to the instruction sheet provided with the Quickset Timer, this article has an alarm function, count up timer, count down timer and built-in memory function. The Quickset Timer is contained in a blister display package. The essential character of this composite article is derived from the timer.

The applicable subheading for the Quickset Timer will be 9106.90.85, Harmonized Tariff Schedule of the United States (HTS), which provides for time of day recording apparatus and apparatus for measuring, recording or otherwise indicating intervals of time, with clock or watch movement or with synchronous motor; other; other; other. The rate of duty will be 15 cents each plus 2.3 percent ad valorem plus 0.8 cents per jewel. The rate of duty will remain unchanged in the year 2000.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
