RE: The tariff classification of peanut sauce mix from the Philippines.

Dear Mr. Hume:

In your letter dated November 17, 1999, on behalf of Marigold Commodities Corporation, Philippines, you requested a tariff classification ruling.

Photocopies of the product label and a description of the manufacturing process were submitted with your letter. “Mama Sita’s” Peanut Sauce Mix, Kare-Kare, is said to be composed of peanuts, rice, salt, and annatto powder. The peanuts are blanched, cooled, peeled, roasted, milled into powdered form, mixed with rice powder, salt and annato powder and put up in 57 and 100 gram packages. The mix is dissolved in broth to make a sauce, and used in the preparation of various ethnic foods.

The applicable subheading for the peanut sauce mix will be 2103.90.9060, Harmonized Tariff Schedule of the United States (HTS), which provides for sauces and preparations thereforother otherother. The rate of duty will be 6.6 percent ad valorem. Effective January 1, 2000, the rate of duty will be 6.4 percent ad valorem.

Articles classifiable under subheading 2103.90.9060, HTS, which are products of the Philippines may be entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check the Customs Web site at www.customs.gov. At the Web site, click on "CEBB" then search for the term "GSP".

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
