RE: The tariff classification of parts of caged roller bearing assembly from Germany

Dear Mr. Schau:

In your letter dated November 10, 1999 you requested a tariff classification ruling on behalf of your client Sauer Sundstrand.

The item in question is described as a caged roller bearing assembly and identified as part number 746321. Descriptive information, technical drawings and a sample were submitted.

The caged roller bearing assembly is comprised of two hardened steel bearing races with fixed locator pins and two plastic cage components, each of which contains 13 cylindrical rollers. The bearing assembly is designed to be incorporated into the body o a hydraulic pump and permits the movement of a swashplate against the interior of the pump housing.

You indicate that the cylindrical rollers used in the bearing assembly are approximately 8.5 millimeters in diameter and 31.5 millimeters in length. However, the rollers contained in the submitted sample were found to measure 5.0 millimeters in diameter and 17.65 millimeters in length.

The applicable subheading for the caged roller bearing will be 8482.40.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for needle roller bearings. The rate of duty will be 5.8 percent ad valorem.

It is the opinion of this office that the subject caged roller bearing will be subject to anti-dumping margins under current orders of the Department of Commerce related to antifriction bearings. The scope of the current orders includes cylindrical roller bearings having rollers of a length that is less than four times the diameter of the roller. Please contact your local port for the specific case numbers and percentages. If you desire a binding ruling on the applicability of either anti-dumping or countervailing duty to your product, please write directly to the Office of Compliance, Department of Commerce, Washington, D.C.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
