RE: The tariff classification of parts of an electric air pump from Germany

Dear Ms. Vinson:

In your letter dated November 1, 1999 you requested a tariff classification ruling on behalf of your client Pierburg.

The items in question are parts of an electric secondary air pump for a motor vehicle. Technical literature and samples were submitted. The parts are identified as follows:

A support disc, part number 3.61968.10.

A two-piece rubber bearing, part numbers 3.46915.07 and 3.64116.03, made of EPDM synthetic rubber.

A wire harness, part number 5.34484.04, rated at 13.5 volts.

A DC motor, part number 5.35951.06, with output wattage of 430 watts.

A damper, part number 3.64457.00 made of NR rubber.

The technical literature submitted indicates that the air pump is a form of radial blower mounted in a plastic housing and driven by an electric motor. The function of the pump is to provide a secondary airflow for a gasoline engine and is designed for use in motor vehicles to improve exhaust emissions. The parts are for use in the assembly of the internal mechanism and housing of the air pump.

The applicable subheading for the support disc will be 8414.90.1080, Harmon zed Tariff Schedule of the United States (HTSUS), which provides for other parts of fans, including blowers. The rate of duty will be 4.7 percent ad valorem.

The applicable subheading for the rubber bearing and the damper will be 4016.99.6050, HTSUS, which provides for other articles of vulcanized rubber other than hard rubber other. The rate of duty will be 2.5 percent ad valorem.

The applicable subheading for the wire harness will be 8544.41.8000, HTSUS, which provides for other electric conductors, for a voltage not exceeding 80 V other. The rate of duty will be 2.6 percent ad valorem.

The applicable subheading for the DC motor will be 8501.31.4000, HTSUS, which provides for other DC motors, of an output not exceeding 750 watts, exceeding 74.6 watts but not exceeding 735 watts. The rate of duty will be 4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
