RE: The tariff classification of three women’s garments from Hong Kong

Dear Mr. Kelly:

In your letter dated July 6, 1999, on behalf of Jones Apparel Group USA, Inc., you requested a tariff classification ruling. Your samples are being returned.

You submitted three samples of women’s knit garments. Style number PICK14998 is a pullover that features a turtleneck, and ¾ length sleeves. You state that the fiber content for the pullover is 53% wool, 11% cashmere, 11% polyester, 10% angora, 9% nylon, and 6% metallic. The outer surface of the pullover measures 12 stitches per 2 centimeters in the horizontal direction.

Style number P25A9498 is a pullover sweater that features long sleeves and a hood. You state that the fiber content is 44% nylon, 35% mohair, and 21% “wool with lurex”. The outer surface of the pullover sweater measures 9 stitches per 2 centimeters in the horizontal direction.

Style number P25D1488 is a pullover that is constructed from 2x2 rib knit fabric. The garment features a boat neckline and ¾ length sleeves. You state that the fiber content is 57% cotton, 30% rayon, and 13% lurex. The outer surface of the pullover measures more than 9 stitches per 2 centimeters in the horizontal direction.

In order to verify the fiber content of these garments and to analyze the yarn structure of the fabric, we have submitted the samples to the U.S. Customs Laboratory in New York. The laboratory has reported that the overall fiber content of style PICK14998 is 78.5% wool & animal hair and 17.2% metallic yarn. The laboratory has also stated that the garment is composed of one single spun yarn (94.8% wool & animal hair, 5.2% nylon), and one 2-ply metallic yarn (65.3% polyester, 34.7% metallic yarn). The overall fiber content for style P25A9498 is 47.1% wool and animal hair, 37.5% nylon, 15.4% metallic yarn. The garment is composed of one single spun yarn (55.7% wool and fine animal hair, 44.3% nylon), and one 2-ply metallic yarn (65.4% polyester, 34.6% metallic yarn). The overall fiber content for style P25D1488 is 50.9% cotton, 34.7% rayon, 14.4% metallic yarn. The garment is composed of one 2-ply staple yarn (100% cotton), one singles filament yarn (100% rayon), and one 2-ply metallic yarn (64.6% polyester, 35.4% metallic yarn.

The applicable subheading for style PICK14998, the pullover, will be 6110.10.2080, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s pullovers, knitted: of wool or fine animal hair: other. The duty rate will be 16.5% ad valorem. The duty rate in 2000 will be 16.4% ad valorem.

The applicable HTS subheading for style P25A9498, the pullover sweater, will be 6110.10.2030, which provides for women’s sweaters, knitted: of wool or fine animal hair: other. The duty rate will be 16.5% ad valorem. The duty rate in 2000 will be 16.4% ad valorem.

The applicable HTS subheading for style P25D1488, the ribbed pullover, will be 6110.20.2075, which provides for women’s pullovers, knitted: of cotton: other. The duty rate will be 18.6% ad valorem. The duty rate in 2000 will be 18.2% ad valorem.

Style PICK14998 falls within textile category designation 438; style P25A9498, 446; style P25D1488, 339. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
