RE: The tariff classification of a handbag and backpack from Indonesia.

Dear Ms. Greener:

In your letter dated October 18th, 1999, you requested a classification ruling.

The samples submitted with your request are identified as item #063-0022, "rolling backpack" and item #063-0026, "mini backpack".

Item #063-0026 is a handbag designed to carry money, keys, and small accessories on a daily basis. The bag measures approximately 10 1/2" by 8 1/2" by a 3 1/4" gusset and has an exterior surface of 100% polyester. Two adjustable, permanently attached shoulder straps enable use as a backpack. The bag has two compartments, a central compartment and an auxiliary compartment on the front exterior, both with zip-around closures. The central compartment incorporates a plastic D-ring and an open pocket. The auxiliary compartment features two open pockets, a small zippered mesh pocket and a dog leash type clasp affixed to a sewn-in cord. A full-width zippered pocket is included on the front exterior of the auxiliary pocket.

Item #063-0022 is a backpack on wheels designed to carry clothing and various personal effects during travel. The bag measures approximately 20 1/2" in height by 13" in width by a 6 3/4" bottom panel and has an exterior surface of 100% polyester. The interior of the bag is non-compartmentalized, has a zippered mesh pocket that covers the entire area of the interior front flap, and is secured by a zip-around closure. Adjustable straps are sewn into the back interior to secure items placed therein. The front exterior of the bag features an additional zip-around compartment, the interior of which features an open pocket, zippered mesh pocket, multiple credit card slots, and a dog leash type clasp affixed to a sewn-in cord. A zippered pocket is included on the front exterior of the additional compartment. The rear of the bag features two shoulder straps, a plastic pull out handle that enables the user to pull the backpack on wheels, and a lower flap, secured by hook and loop closures, with which the user can cover the wheels when wearing the backpack on one's back.

The applicable subheading for item #063-0022 will be 4202.92.3020, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports, and similar bags, with outer surface of textile materials, other, other, of man-made fibers, backpacks. The duty rate will be 18.8% ad valorem.

The applicable subheading for item #063-0026 will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strapwith outer surface of textile materials, other, other, other, of man-made fibers. The duty rate will be 18.8% ad valorem.

Items classifiable under HTS subheading 4202.92.3020 and 4202.22.8050 fall within textile category designation 670. Based upon international textile trade agreements products of Indonesia are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
