RE: The tariff classification of watches, toy cars, stereo cassette players and calculators from China

Dear Mr. Battistic:

In your letter dated November 2, 1999 you requested a tariff classification ruling.

Item 3106-9-V consists of a wrist watch with an opto-electronic display, and a radio controlled toy car. The two items are blister packaged and sold together. The second item consists of a wrist watch with an opto-electronic display, a stereo cassette player, and a calculator. The three items are blister packaged and sold together.

Tariff classification is determined in accordance with the General Rules of Interpretation (GRIs) of the Harmonized Tariff Schedule of the United States. For the purposes of the Harmonized Tariff Schedule of the United States, each of the items listed above is separately classifiable in its respective subheading. GRI 3 is noted.

The applicable subheading for the wrist watches with opto-electronic displays will be 9102.12.80, Harmonized Tariff Schedule of the United States (HTS), which provides for wrist watches, electrically operated, whether or not incorporating a stop watch facility; with opto-electronic display only, other. The rate of duty will be free.

The applicable subheading for the straps for the wrist watches will be 9102.12.40, Harmonized Tariff Schedule of the United States (HTS), which provides for straps, bands or bracelets entered with watches of subheading 9102.12.80 and classifiable therewith pursuant to additional U.S. note 2 to this chapter; all the foregoing whether or not attached to such watches at the time of entry. The rate of duty will be free.

The applicable subheading for the radio controlled toy car will be 9503.80.0025, Harmonized Tariff Schedule of the United States (HTS), which provides for other toys and models, incorporating a motor. The rate of duty will be free.

The applicable subheading for the stereo cassette player will be 8519.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for pocket-size cassette players. The rate of duty will be free.

The applicable subheading for the calculator will be 8470.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for electronic calculators. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
