RE: The tariff classification of chenille yarn from Taiwan or Indonesia

Dear Mr. Kao:

In your letter dated October 22, 1999, you requested a classification ruling.

You submitted a sample of a yarn and stated that it is made of 100 percent acrylic fiber. It is a chenille yarn that you intend to sell for use in sweater knitting or textile weaving. It is not intended to be sold at retail. It is identified as style AC1300-CD.

The applicable subheading for the chenille yarn will be 5606.00.0090, Harmonized Tariff Schedule of the United States (HTS), which provides for gimped yarn, and strip and the like of heading 5404 or 5405, gimped (other than those of heading 5605 and gimped horsehair yarn); chenille yarn (including flock chenille yarn); loop wale-yarn. The duty rate will be 9.8 percent ad valorem.

The chenille yarn falls within textile category designation 201. Based upon international textile trade agreements products of both Taiwan and Indonesia are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
