RE: The tariff classification of an all-purpose hamper from China.

Dear Ms. Stillwell:

In your letter dated October 21, 1999, on behalf of Bajer Design, you requested a tariff classification ruling.

The submitted sample is a collapsible all-purpose hamper. The hamper is rectangular in shape and measures 17 ¾” wide by 24 ½” high by 17 ¾” deep. The item is made of nylon fabric and mesh which is wrapped around a metal frame, and features a drawstring closure, web nylon carrying handles and padded nylon web straps for carrying on one’s back. The hamper is designed to be placed on the floor or ground.

Your sample is being returned as requested.

The applicable subheading for the all-purpose hamper will be 9403.80.6040, Harmonized Tariff Schedule of the United States (HTS), which provides for other furniture and parts thereof: furniture of other materials, other, household. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
