RE: The tariff classification of RF power amplifiers.

Dear Mr. Tuttle:

In your letter dated October 19, 1999, on behalf of your client Spectrian Corporation, you requested a tariff classification ruling.

The items in question are denoted as RF power amplifiers for use within cellular telephone base stations. The linear RF power amplifiers are denoted as the following models:

1. SC33 PCN Series Single Channel Power Amplifier (SCPA) 2. MCPS 2100 Series Multi-channel Power Amplifier (MCPSA)

The SC33 PCN Series single channel power amplifier is configured between the individual cellular radio transceiver and a high power combiner that is connected to the transmission antenna. The amplifier is designed to boost (amplify) the low level output signal from the transceiver to a high power signal for further transmission to the antenna.

The MCPS 2100 Series multi-channel power amplifier is designed so that the low power wideband signal of each cellular radio transceiver is fed into it where each signal is combined, filtered and boosted (amplified) to a higher signal strength. The composite signal is then fed to the antenna for transmission.

Both of these signal amplifiers are designed to boost radio frequency inputs to the required levels for transmission through the ether.

The applicable subheading for the RF signal power amplifiers will be 8525.10.9090, Harmonized Tariff Schedule of the United States (HTS), which provides for Transmission apparatus for radiotelephony, radiotelegraphy, radiobroadcasting or television, whether or not incorporating reception apparatus or sound recording or reproducing apparatus; television cameras; still image video cameras or other video camera recorders: Transmission apparatus: Other Other. The general rate of duty will be 1.1 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
