RE: The tariff classification of printed pictures from Denmark and Great Britain

Dear Ms. Yeager:

In your letter dated October 19, 1999, you requested a tariff classification ruling.

Samples were submitted, which will be retained for reference, unless you require their return. They are two offset lithographically printed pictures on paper, permanently mounted and framed, suitable for hanging as decoration on walls in homes or offices.

One sample is designated Article 70017101, “Robust”. It is a black and white reproduction of a photograph of the Eiffel Tower, by Rolf Uicker. It is said to weigh 5.5 kg, and measure 47 cm x 120 cm. “Robust” is a product of Denmark.

The second sample is designated Article 16567595, “Husby”. It is a reproduction in color of a painting titled “The Singing Butler”, by Jack Vettriano. It is said to weigh 2.39 kg, and measures 53 cm x 47 cm. “Husby” is a product of Great Britain.

The applicable subheading for these pictures will be 4911.91.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for: Lithographs on paper or paperboard: Over 0.51 mm in thickness (the combined thickness of the lithograph and its mounting). The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
