RE: The tariff classification of a "Golf Ball Retriever Cover" from Taiwan.

Dear Mr. McCarthy:

In your letter dated October 7th, 1999, on behalf of Pro Line Retrievers, you requested a classification ruling.

The sample submitted with your request is identified as "Golf Ball Retriever Cover". A style number was not included with your inquiry. You state that the retriever cover will not be imported with a golf ball retriever. The article is a fitted container designed to provide storage, protection, organization and portability for a particular device, i.e., the ball retriever. The container is designed to completely cover the item placed therein. It is manufactured of 100% nylon and consists of a 3 1/8" wide strip that spans 13 1/2" in length, at which point the item expands into the shape of a circle, 4 7/8" in width, at the widest points. The total height by the item is approximately 18". The top opening of the container is secured by a zippered closure.

If the article is presented in a heat sealed clear plastic bag, the bag must be permanently, conspicuously and legibly marked with the country of origin. A pressure sensitive label will not be acceptable. If imported in an unsealed poly bag, each article must be marked by means of a sewn-in label. The sewn-in label may be placed inside or outside of the container. If placed inside, it must be in a conspicuous location in the vicinity of the top opening.

The applicable subheading for the "Golf Ball Retriever Cover" will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS) which provides for gun cases, holsters, and similar containerswith outer surface of textile materials, other, of man-made fibers. The duty rate will be 18.8% ad valorem.

Items classifiable under HTS subheading 4202.92.9026 fall within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
