RE: The tariff classification of Mifepristone (CAS-84371-65-3), imported in bulk form, from China

Dear Mr. Chivini:

In your letter dated October 22,1999, you requested a tariff classification ruling.

The subject product, Mifepristone, also referred to as RU-486, is a synthetic antiprogestin derived from (the synthetic progestin) norethindrone. According to the PDR® Medical Dictionary, an “antiprogestin” is “[A] substance that inhibits progesterone formation, that interferes with its carriage or stability in the blood, or that reduces its uptake by, or effects on, target organs (e.g., RU-486).” At the present time, Mifepristone has not been approved for general marketing by the U.S. Food & Drug Administration (FDA).

The applicable subheading for Mifepristone, imported in bulk form, will be 2937.92.5050, Harmonized Tariff Schedule of the United States (HTS), which provides for: "[E]strogens and progestins: Other: Other: Other: Other." The rate of duty will be free.

This merchandise may be subject to the requirements of the Federal Food, Drug, and Cosmetic Act, which is administered by the U.S. Food and Drug Administration. You may contact them at 5600 Fishers Lane, Rockville, Maryland 20857, telephone number 301-443-1544.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
