RE: The tariff classification of “Tuftec H1272” hydrogenated styrene butadiene block copolymer from Japan.

Dear Mr. Francis:

In your letter received October 15, 1999, on behalf of Alphagary Corporation, you requested a tariff classification ruling.

The product designated “Tuftec H1272” is described as a hydrogenated styrene-butadiene block copolymer consisting of 34 percent by weight styrene and 66 percent butadiene, with incomplete saturation. Based on examination of the rubber dumbbell samples vulcanized with sulfur, the product appears to meet the definition of synthetic rubber in Chapter 40 Note 4(a), Harmonized Tariff Schedule of the United States (HTS), and is classifiable in subheading 4002.19.0010, HTS, which provides for other styrene-butadiene rubber containing 50 percent or less styrene by weight of the dry polymer. The rate of duty is free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
