RE: The tariff classification of sleeve protectors from China.

Dear Ms. Everitt:

In your letter dated October 5, 1999 you requested a tariff classification ruling.

The submitted samples are sleeve protectors composed of a polyethylene laminated to a non-woven fabric with elastic at both ends. The sleeve protectors will be used to protect the clothing of workers in hospitals, laboratories and the food processing industry. The polyethylene plastic material imparts the essential character of the sleeve protectors.

The applicable subheading for the sleeve protectors will be 3926.20.9050, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other articles of plastics and articles of other materials of headings 3901 to 3914: Articles of apparel and clothing accessories (including gloves): Other: Other, Other.” The rate of duty will be 5% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
