RE: The tariff classification of child’s sleep sack from Hong Kong

Dear Mr. Alberdi:

In your letter dated November 1, 1999, on behalf of your client Florida Found Inc., you requested a tariff classification ruling. The sample is being returned as requested.

The submitted sample is a child’s sleep sack designated as a “SnuggleBug NapSac”. It is constructed of panels of nylon woven fabric sewn together in layers with a knit pile lining and then assembled into a sleep sack. The sleep sack measures 54 inches long by 22 inches wide and is designed as an all in one sleep system for children ages 2 to 5. This article has not been stuffed with any material and depends upon the knit pile lining in combination with the nylon woven outer fabric to provide warmth. It features a pillow and has been manufactured to fold into a convenient backpack like configuration with woven nylon shoulder straps to facilitate carrying the sleep sack to daycare, sleepovers or anywhere a child may have occasion to travel.

The applicable subheading for the sleep sack will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles, including dress patterns, other, other, other, other, other. The rate of duty will be 7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
