RE: The tariff classification of cotton yarn waste from Colombia

Dear Mr. Pavlica:

In your letter dated October 20, 1999, you requested a tariff classification ruling.

You submitted a bag of cotton yarn which you termed waste. Although you state the waste is made of 100 percent cotton, there appears to be yarns containing elastomeric fibers in the mix. For purposes of this ruling, we will assume that the waste is composed of 50 percent or more by weight of cotton. The product appears to be a mass of tangled, broken and knotted yarns of varying lengths. You state that it will be used as a cleaner product in industrial and home uses.

The applicable subheading for the cotton yarn waste will be 5202.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for cotton waste (including yarn waste and garnetted stock), yarn waste (including thread waste). The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
