RE: The tariff classification lithium-ion battery cells from France.

Dear Mr. Leeds:

In your letter dated September 30,1999, you requested a tariff classification ruling.

As described in your letter, the lithium-ion battery cells are used as a source of electrical power on board communication satellites. Lithium-ion battery technology is being used because it is lightweight, rugged and capable of providing power over a 15-20 year period.

The applicable subheading for the lithium-ion battery cells will be 8507.80.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for other storage batteries; other. The rate of duty will be 3.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
