RE: The tariff classification of men’s swimsuits from China.

Dear Ms. Greener:

In your letter dated October 8, 1999, you requested a classification ruling. As requested, the samples will be returned to you.

You have submitted two samples. Style 005-1965/66 is a man’s 100% nylon woven swimsuit. The garment features an enclosed elasticized waist, an interior adjustable drawstring, adjustable elasticized belt with a plastic buckle, 100% nylon mesh liner, an interior coin pocket, back pockets, one fastened with a zippered closure and the other has a flap fastened with a hook and loop closure, front side pockets, one with interior zippered pocket, a flapped cargo pocket fastened with a hook and loop closure on the lower left leg, a plastic loop on the waistband and hemmed bottoms. Style 005-1965 is for regular size items. Style 005-1966 is for tall sized items.

Style 005-1973 is a man’s 100% nylon woven swimsuit. The garment features an enclosed elasticized waist, an interior adjustable drawstring, 100% nylon mesh liner, an interior coin pocket, back pocket fastened with a zippered closure, front slash pockets, a flapped cargo pocket fastened with a hook and loop closure on the lower left leg, a plastic loop on the waistband and hemmed bottoms

The applicable subheading for styles 005-1965/66 and 005-1973 will be 6211.11.1010, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear, other garments: swimwear: men’s or boys’: of man-made fibers, men’s. The duty rate will be 28.7 percent ad valorem.

Styles 005-1965/66 and 005-1973 fall within textile category designation 659. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
