RE: The tariff classification of men’s woven cotton shorts from Sri Lanka.

Dear Ms. Pitts:

In your letter dated October 6, 1999 you requested a classification ruling. As requested your samples are being returned to you.

Style M15M122 is a pair of men’s woven shorts made 70% cotton and 30% nylon. The garment has a flat waistband with a Velcro closure and two tabs with two grommets each and a tie for tightening; it has a fly with a Velcro closure, two inserted side seam mesh pockets, a flapped cargo pocket on each leg with a Velcro closure, a coin pocket on the interior waistband, an overlaid stripe on each leg and hemmed leg bottoms.

The applicable subheading for style M15M122 will be 6203.42.4050, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s woven cotton shorts. The duty rate will be 17.2% ad valorem.

Style M15M122 falls within textile category designation 347. Based upon international textile trade agreements products of Sri Lanka are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

Your inquiry does not provide enough information for us to give a classification ruling on styles M15M003 and M15M121. Your request for a classification should include:

Please supply brochures, catalogues, advertising material, etc., showing how the merchandise is bought and sold.

Whether the garments are specifically designed and constructed for swimming.

Whether the fabric liner is specially engineered, e.g., coolmax, or chemically treated to keep its wearer cool, dry or comfortable while exercising.
