RE: The tariff classification of kitchen towels from Hong Kong.

Dear Mr. Murphy:

In your letter dated September 9,1999, received by this office on October 13, 1999, you requested a classification ruling on behalf of First Success Trading Limited. As requested the samples are being returned.

The submitted samples are kitchen towels. Sample A is made from 100 percent cotton flat woven fabric. It measures approximately 23 x 30 inches and all of the edges are hemmed. Sample A features drawn work and is embroidered with the word “Crystal”. Sample B is made from 100 percent linen woven fabric and it measures approximately 25.5 x 26.5 inches. The white towel has black yarn dyed stripes and is embroidered with the words “Haute Home”. You have also indicated that some of these towels will be made from a 60 percent linen and 40 percent cotton woven blend. As requested the towels are being returned.

The applicable subheading for Sample A will be 6302.91.0045, Harmonized Tariff Schedule of the United States (HTS), which provides for bed linen, table linen, toilet linen and kitchen linen: other: of cotton other: towels: other: dish. The duty rate will be 9.8 percent ad valorem.

The applicable subheading for Sample B and the kitchen towels made from the linen and cotton blend will be 6302.92.0010, HTS, which provides for bed linen, table linen, toilet linen and kitchen linen: other: of flax towels. The duty rate will be 1.2 percent ad valorem.

In your letter you also refer to cotton damask kitchen towels. Without a sample we are unable to provide you with a ruling. Please note, however, that a damask fabric is made on a jacquard loom and that there is a statistical breakout for jacquard figured towels under subheading 6302.91, Harmonized Tariff Schedule of the United States

Sample A falls within textile category designation 369. Sample B and the other linen blend towels fall within textile category designation 863. Based upon international textile trade agreements Sample A from Hong Kong is subject to quota and the requirement of a visa. Sample B and the linen blend towels are subject the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
