RE: The tariff classification of a scum scraper system from Canada

Dear Mr. Krueger:

In your letter dated September 20, 1999 on behalf of H. Fontaine, Ltd., of Magog, PQ, Canada you requested a tariff classification ruling.

The Scum Scraper System is normally installed in a rectangular clarifier at a wastewater treatment plant. The primary function of the clarifier or sedimentation tank is to produce a clarified effluent. Suspended solids with a higher specific gravity than liquid will tend to settle and be removed as sludge. Those with a lower specific gravity will tend to rise and float. The scum scraper removes this floating material or “scum”. It draws the scum from the water’s surface and discharges it into a trough. The scraper consists essentially of a motor, sprocket gear and chain assembly attached to a stainless steel frame with an adjustable arm connected to the steel scraper.

The applicable subheading for the Scum Scraper System will be 8421.99.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for parts of machinery and apparatus for filtering or purifying water. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
