RE: The tariff classification of knitted handbags from China.

Dear Mr. Su:

In your letter dated September 7th, 1999, you requested a classification ruling for knitted handbags from China.

The two samples submitted with your request are identified as style numbers 1901 and 1902. The items are ladies' handbags designed to carry money, keys, and small accessories during travel. Both have an exterior surface of 55% linen and 45% cotton knitted textile material. Style #1901 measures approximately 7" in height by 5" in width and incorporates a shoulder strap and a top hook and loop closure. Style #1902 measures approximately 7 1/2" in height by 5" in width and incorporates a shoulder strap and a top drawstring closure.

You have also indicated that you will import a handbag identified as style #1903, which will be of the same size and design as style #1901. The exterior surface of the bag will be made of 100% polypropylene.

The applicable subheading for style #1901 and #1902 will be 4202.22.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strapwith outer surface of textile materials, other, of vegetable fibers and not of pile or tufted construction, other. The duty rate will be 6.1% ad valorem.

Items classifiable under HTS subheading 4202.22.6000 fall within textile category designation 871. Based upon international textile trade agreements products of China are subject to the requirement of a visa.

The applicable subheading for style #1903 will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strapwith outer surface of textile materials, other, other, other, of man-made fibers. The duty rate will be 18.8% ad valorem.

Items classifiable under HTS subheading 4202.22.8050 fall within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
