RE: The tariff classification of gloves from Hong Kong, Korea and China.

Dear Mr. Edwards:

In your letter dated August 25, 1999, you requested a classification ruling.

Five samples were provided for review. Style 86031 is a glove constructed of a finely knitted interlock cotton fabric in a size medium. The glove features a partially elasticized wrist on the palmside, fourchettes, a hemmed bottom, and a three line stitch design down the backside knuckle area. You have indicated that the gloves will be used by fine hotels for catering, military honor guards, academy cadets, and school bands. The gloves will be available in sizes (S to XXL), additional styles numbers include 86000, 86062, 86093, and 86097.

Style 87031 is similar to the above-referenced style 86031 with the exception of a vented wrist which is secured by means of a palmside metal snap closure. The gloves will be available in sizes (XS to XL), additional style numbers include 87001, 87000, 87062, and 87093.

Style 86162 is a size large glove with the palmside constructed of a PVC dot coated finely knitted interlock cotton material. The PVC coating weights less then 50% of the coated knitted fabric. The backside of the glove is constructed of a knitted cotton fabric. The glove features fourchettes, a three line stitch design down the backside knuckle area, and a trimmed vented wrist. The essential character of the glove is imparted by the palmside coated knitted material. The gloves will be available in sizes (S to XL), additional style numbers include 86100, 86131, and 86193.

Style 71211 is a glove constructed of a finely knitted interlock cotton fabric in a size medium. The glove features a hemmed bottom. You have indicated that the gloves will be used in industry and for medical purposes. The gloves will be available in sizes (S to XL), additional style numbers include 71210, 71213, and 71215.

Style 21638 is a half fingered glove constructed of a 90% cotton 10% spandex knitted fabric. This one size fits all glove features a hemmed bottom and overlock stitching at the finger openings. You have indicated that the gloves will be used by school bands.

Please note that Rule No. 6 of The Textile Fiber Products Identification Act requires the use of generic fiber names when marking textile products.

The applicable subheading for styles 86031, 86000, 86062, 86093, 86097, 87031, 87001, 87000, 87062 and 87093 will be 6116.92.7470, Harmonized Tariff Schedule of the United States (HTS), which provides for Gloves, mittens and mitts, knitted or crocheted: other: of cotton: other: made from a pre-existing machine knit fabric: with fourchettes . . . other. The duty rate will be 24.2 percent ad valorem.

The applicable subheading for styles 86162, 86100, 86131, and 86193 will be 6116.10.7510, HTS, which provides for Gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other: with fourchettes: containing 50 percent or more by weight of cotton, man-made fibers or other textile fibers, or any combination thereof . . . subject to cotton restraints. The duty rate will be 13.6 percent ad valorem.

The applicable subheading for styles 71211, 71210, 71213, 71215 and 21638 will be 6116.92.6440, HTS, which provides for Gloves, mittens and mitts, knitted or crocheted: other: of cotton: other: made from a pre-existing machine knit fabric: without fourchettes . . . other. The duty rate will be 24.2 percent ad valorem.

All styles fall within textile category designation 331. Based upon international textile trade agreements products of Hong Kong, Korea and China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
