RE: The tariff classification of auto-balancers from Sweden

Dear Mr. Simpson:

In your letter dated August 12, 1999 on behalf of SKF USA Inc. you requested a tariff classification ruling.

DynaSpinTM auto-balancers basically consist of a number of loose balls that can move freely in an induction hardened raceway. They are designed to reduce vibrations caused by an imbalance in a rotating shaft. Vibrations occur when a rotating shaft’s center of gravity does not coincide with its geometric center. When a DynaSpinTM unit is mounted on the rotor, the balls act as a counterweight by automatically shifting their position to create a state of balance. As the rotor spins and the imbalance varies, centrifugal force causes the balls to continuously move to correct the imbalance. DynaSpinTM auto-balancers are capable of reducing vibrations in power tools such as drills and grinders, fans, pumps, centrifuges, turbines, washing machines, and numerous other machines. According to the submitted literature, a DynaSpinTM auto-balancer cannot be used as an anti-friction bearing since it cannot carry any external weight. It rotates with the shaft while the balls move within the casing.

The applicable subheading for the DynaSpinTM auto-balancers will be 8485.90.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for machinery parts, not containing electrical connectors, insulators, coils, contacts or other electrical features, and not specified or included elsewhere (in chapter 84): other: other. The rate of duty will be 3.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
