RE: The tariff classification of polyethylene net wrapping material and polyethylene film wrapping material.

Dear Mr. Watkins:

In your letter dated August 4, 1999, you requested a tariff classification ruling.

Two samples were provided with your letter. The net wrapping material is a warp knit fabric with a stable open mesh. We assume that the net wrapping material is over 30 centimeters in width. The film wrapping material is composed of polyethylene film. These products are used with hay and silage-making machinery. Although the products may be used with such machinery, they are not a part of the machinery.

You did not state the country of origin in your letter, though you did state that the products will be imported from Europe. These products are not subject to quota or visa requirements when made in Europe. The rates of duty provided below are those rates applicable to countries with which the United States has for Normal Trade Relations.

The applicable subheading for the net wrapping material will be 6002.43.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for other fabrics, warp knit (including those made on galloon knitting machines): of man-made fibers, open-work fabrics. The rate of duty will be 12 percent ad valorem.

The applicable subheading for the polyethylene film wrapping material will be 3920.10.0000, HTS, which provides for other plates, sheets, film, foil and strip, of plastics, noncellular and not reinforced, laminated, supported or similarly combined with other materials, of polymers of ethylene. The rate of duty will be 4.2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
