RE: The tariff classification of an eye pillow from Canada.

Dear Mr. Hardy:

In your letter dated August 4, 1999, you requested a tariff classification ruling.

Illustrative literature was submitted with your letter. The Radiant Touch eye pillow is said to consist of 60 percent rice, 30 percent fabric, and 5 percent each of flax and lavender/chamomile. The pillow is used to provide relief for eyestrain, headache and promotes relaxation.

The applicable subheading for the eye pillow will be 1404.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for vegetable products not elsewhere specified or includedÂother. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
