RE: The tariff classification of orange pulp wash from Brazil

Dear Mr. Goodman:

In your letter dated July 19, 1999, received by this office on August 10, 1999, you requested a tariff classification ruling.

A sample, submitted with your letter, was examined and disposed of. The product is described as orange pulp wash. It is prepared from the pomace remaining after the extraction of orange juice. The pomace, the spent juice sacs, are separated from the fruit juice and “washed” with water, to recover whatever juice remains in the sacs. The product thus recovered is concentrated to 65° Bx and packed in plastic-lined 55-gallon drums. Orange pulp wash concentrate is used as an ingredient in fruit-flavored drinks.

The applicable subheading for the orange pulp wash will be 2106.90.9973, Harmonized Tariff Schedule of the United States (HTS), which provides for food preparations not elsewhere specified or includedÂotherÂotherÂpreparations for the manufacture of beveragesÂother. The rate of duty will be 7 percent ad valorem.

Articles classifiable under subheading 2106.90.9973, HTS, which are products of Brazil may be entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check the Customs Web site at www.customs.gov. At the Web site, click on "CEBB" then search for the term "GSP".

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
