RE: The tariff classification of a briefcase and handbags and from Indonesia and the Philippines.

Dear Ms. Greener:

In your letter dated August 12th, 1999, you requested a classification ruling for a briefcase and handbags from Indonesia and the Philippines.

The samples submitted with your request are identified as item numbers 023-0023, "Nylon Laptop Backpack Briefcase"; 023-0026, "Nylon Guide Bag"; 023-0027, "Nylon Shoulder Bag"; and 023-0088, "Nylon Twill X-Body Pouch".

Item 023-0023 is similar to a briefcase or school satchel and measures approximately 12.5" in height by 13/5" in width by 7" in diameter. The bag is constructed of 100% nylon and features a carry handle, an adjustable shoulder strap, and straps that enable use as a backpack. Both the front and rear exteriors have a full-length zippered pocket. A front flap with two tuck lock closures secures the bag and conceals a padded zippered compartment that is designed to hold a lap top computer. This compartment also contains multiple open pouches, pencil slots, a zippered pocket, and a pouch with a hook and loop closure. The interior of the bag consists of two compartments, one of which is padded and is secured by a tab with a hook and loop closure.

The applicable subheading for item #023-0023 will be 4202.12.8030, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases, vanity cases, attache cases, briefcases, school satchels and similar containersÂwith outer surface of textile materials, other, attache cases, brief cases, school satchels, occupational luggage cases and similar containers, other, of man-made fibers. The duty rate will be 18.8% ad valorem.

Item 023-0026 is a handbag made of 100% nylon that measures 6" in width by 9.5" in height by 2" in diameter. The exterior of the bag has two zippered pockets. The interior of the bag consists of two compartments, the rear of which contains open pockets, zippered pockets, credit card slots, and a pouch with a hook and loop closure.

The applicable subheading for item #023-0026 will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strapÂwith outer surface of textile materials, other, other, other, of man-made fibers. The duty rate will be 18.8% ad valorem.

Item 023-0027 is a ladies' handbag constructed of 100% nylon that measures approximately 12" in width by 12" in height by 2.5" in diameter. A front flap with a hook and loop closure secures the bag and conceals a pocket with a snap closure. The interior of the bag consists of a single compartment with a separate zippered back wall pocket.

The applicable subheading for item #023-0027 will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strapÂwith outer surface of textile materials, other, other, other, of man-made fibers. The duty rate will be 18.8% ad valorem.

Item 023-0088 is a ladies' handbag constructed of 100% nylon that measures approximately 10 1/2" in width by10 1/2" in height. The interior of the bag consists of a single compartment that is secured by a zippered closure. A zippered pocket is located on the front exterior of the bag. A pouch with a front flap secured by a hook and loop closure extends from the top of the bag and attaches to an adjustable shoulder strap.

The applicable subheading for item #023-0088 will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strapÂwith outer surface of textile materials, other, other, other, of man-made fibers. The duty rate will be 18.8% ad valorem.

Items classifiable under HTS subheadings 4202.12.8030 and 4202.22.8050 fall within textile category designation 670. Based upon international textile trade agreements products of Indonesia and the Philippines are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
