RE: The tariff classification of a box from China.

Dear Ms. Antrim-Saizan:

In your letter dated July 26, 1999, on behalf of Monarch Designs international, Fremont, California, you requested a tariff classification ruling. The sample is being returned as requested.

The sample submitted is a box with a detached lid, item number MDB625. The article will also be imported in item numbers MDB425 and MDB525. The boxes measure approximately 6 ¼” x 6 ¼” x 2 ¾”, 4 ¼” x 4 ¼” s 2 ¼” and 5 ¼” x 5 ¼” x 2 ¼”. The submitted sample item number MDB625 is constructed of a coated wire frame covered with organza fabric. The box is not specially constructed to hold any particular item and does not contain any compartments.

The applicable subheading for the box will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other. The rate of duty will be 7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
