RE: The tariff classification of a small briefcase from China.

Dear Ms. Woodford:

In your letter dated July 16, 1999, you requested a tariff classification ruling for a small briefcase.

You have submitted a photo of an item similar to a small briefcase manufactured of rigid polypropylene plastics. No style number indicated. The case appears to have a top carry handle and lock fastener of molded plastic. The case is said to measure approximately 9”(W) x 7”(H).

The applicable subheading for the briefcase will be 4202.12.2010, Harmonized Tariff Schedule of the United States (HTS), which provides for attaché cases, briefcases, school satchels, occupational luggage cases and similar containers, with outer surface of plastics, structured rigid on all sides. The rate of duty will be 20 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
